Terms of Service

By creating an account or using Giget.ai ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, do not use the Platform. These terms apply to all users — buyers, sellers, and visitors.

We reserve the right to update these terms at any time. Continued use after changes constitutes acceptance. We will notify registered users of material changes via email.

Giget.ai is an online marketplace that connects independent freelancers ("Sellers") with clients seeking services ("Buyers"). Giget.ai is a technology platform only — we do not perform services, employ Sellers, or guarantee service outcomes.

All contracts for services are formed directly between Buyers and Sellers. Giget.ai is not a party to those contracts. We provide payment processing, dispute resolution tools, and a marketplace interface to facilitate those transactions.

Payment Processing: All payments on Giget.ai are processed by Stripe, Inc. By using Giget.ai, you also agree to Stripe's Services Agreement and Stripe Connected Account Agreement.

Platform Fee: Giget.ai charges Sellers a 10% commission on each completed order. This fee is automatically deducted from the payment before it is released to the Seller. Buyers pay zero platform fees.

Escrow: Buyer payments are held in escrow by Stripe until the order is marked complete and approved. Funds are released to the Seller within 1–2 business days of order completion.

Refunds: Buyers may request a refund before delivery. After delivery, refunds are at the Seller's discretion unless a dispute is raised. Giget.ai's dispute resolution team makes final refund decisions in escalated cases.

Payouts: Sellers receive payouts directly to their bank account via Stripe Connect. Payout timing depends on your country and Stripe's standard payout schedule (typically 1–7 business days).

Fee Circumvention: Users who meet through Giget.ai are prohibited from taking transactions off-platform for 24 months. Violations may result in account termination and legal action.

As a Seller, you agree to:

• Deliver services as described in your listing, on time and to the agreed standard
• Hold all required licenses, permits, or certifications for your services
• Accurately represent your skills, qualifications, and experience
• Respond to buyer messages within a reasonable timeframe
• Report and pay all applicable taxes on income earned through the platform
• Maintain a professional standard of communication and conduct

Sellers are independent contractors, not employees of Giget.ai. You are solely responsible for your own tax obligations, business compliance, and professional conduct.

As a Buyer, you agree to:

• Provide accurate, complete requirements when placing an order
• Review and approve (or dispute) delivered work in a timely manner
• Not request services that are illegal, harmful, or violate these terms
• Pay for services as agreed — no chargebacks without first raising a dispute through the platform
• Treat Sellers with respect and professionalism

The following are strictly prohibited on Giget.ai:

• Listing or purchasing illegal services of any kind
• Money laundering, fraud, or any form of financial crime
• Fake, incentivized, or retaliatory reviews
• Harassment, threats, hate speech, or discrimination
• Impersonating another person or entity
• Creating multiple accounts to abuse the platform
• Attempting to circumvent platform fees or security measures
• Scraping, crawling, or automated access to the Platform
• Uploading malware, viruses, or harmful code

Violations will result in immediate account suspension and may be reported to relevant authorities.

Upon full payment and order completion, Buyers receive full ownership of the deliverables created for them, unless otherwise agreed in writing with the Seller.

Sellers retain ownership of their pre-existing intellectual property, tools, frameworks, and methodologies. Sellers warrant they have the right to license or transfer any work delivered.

Giget.ai retains ownership of the Platform, its design, code, and brand. You may not reproduce, distribute, or create derivative works based on the Platform without written permission.

Reviews must reflect genuine, personal experiences from completed orders. Reviews may not be:

• Incentivized, purchased, or traded
• Retaliatory or submitted in bad faith
• Submitted by someone with a conflict of interest

Giget.ai reserves the right to remove reviews that violate these policies. Both parties may report abusive reviews through the platform.

We encourage users to resolve disputes directly first. If a resolution cannot be reached within 48 hours, either party may escalate to Giget.ai for mediation.

Giget.ai's decision in a dispute is final. Disputes that cannot be resolved through our mediation process will be subject to binding arbitration under the rules of the American Arbitration Association. Class action litigation is not permitted.

Giget.ai is not a party to disputes between users and does not provide legal advice.

Giget.ai may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or behavior that harms other users or the Platform.

You may delete your account at any time from your account settings. Pending orders and outstanding balances will be settled before account closure. Transaction records required for legal compliance may be retained.

Giget.ai provides the Platform "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Giget.ai is not liable for:

• The quality, accuracy, or outcome of any service delivered through the Platform
• Losses arising from user disputes, fraud, or chargebacks
• Platform downtime, data loss, or technical failures
• Any indirect, incidental, consequential, or punitive damages

Our total liability to you for any claim arising from use of the Platform shall not exceed the total fees paid by you to Giget.ai in the 12 months preceding the claim.

Sellers are solely responsible for determining, reporting, and paying all applicable taxes on income earned through Giget.ai, including but not limited to:

• Federal and state/local income tax
• Self-employment tax (Social Security & Medicare)
• VAT, GST, or other sales taxes where applicable

Giget.ai may issue IRS Form 1099-K to Sellers who meet applicable reporting thresholds. We recommend consulting a qualified tax professional regarding your obligations. This is not legal or tax advice.
